Elections Are Underway, Ballots Mailed

An inadvertent error was made as the election materials went to the printers. Last minute changes to the candidate statements were not included. There is a new candidate statement sheet which you can read on the Elections Page as well as receiving one by regular mail.

Despite what you may have heard by ignorant, or irate and irresponsible owners, the amendments to the Bylaws are designed to imporve the way the association operates. No one is losing any rights! If anyone tells you that, ask them to be specific. Come to the next board meeting on 5/29 at 10 AM when the board will host a Q & A about the amendments.

During the preparation of the election materials, it was discovered that the Bylaws cannot be changed without simultaneously amending the CC&Rs. Further, there are 5 separate CC&Rs which can only be amended by the owners in their respective tract. In other words, the State of Califorinia, County of Kern, and the developer left us with a real mess to deal with. If any improvements are to be made to the faulty governing documents, it will take a massive effort and will likely never happen unless a petition is made in Superior Court. This issue has been overlooked for 40 years by previous boards and all previous association lawyers.
